Unionville Heating & Air Conditioning Ltd. Service Plans
Coverage under this Service Plan begins on the day your enrollment is confirmed (the “Renewal Date”). Unionville Heating & Air Conditioning Ltd. (“UHAC,” “we,” “our,” or “us”) reserves the right to update service fees, maintenance requirements, pricing, and terms as permitted by law. Continued use of services constitutes acceptance of the current Terms and Conditions.
This Service Plan applies only to eligible HVAC equipment as defined in Section 3 of this Agreement.
Unless otherwise stated in your enrollment confirmation, the Service Plan continues for an initial term of twelve (12) months (Annual Plan) or on a month-to-month basis (Monthly Plan). Your selected billing and term structure will be identified in your enrollment or renewal documentation.
- Annual Maintenance Requirement
Annual maintenance is required for all HVAC equipment covered under this Agreement. Required maintenance must be completed within sixty (60) days of the contract start date or Renewal Date.
Late Maintenance
If required maintenance is not completed within the sixty (60) day period, additional charges may apply. Such charges will be determined based on the condition of the equipment and the scope of work required at the time service is performed.
Exclusivity of Service Provider
All inspection, maintenance, service, repair, or replacement work covered under this Service Plan must be performed exclusively by UHAC.
You agree that neither you nor any third party may service, modify, adjust, relocate, disconnect, alter, or tamper with covered equipment without prior written authorization from UHAC.
Unauthorized service or alteration will immediately void coverage for the affected equipment but will not release you from payment obligations under this Agreement.
Nothing herein prevents you from taking reasonable emergency measures to prevent immediate harm, provided UHAC is notified as soon as reasonably possible.
- Automatic Renewal
Payments are due on or before the date specified in your renewal documentation. Overdue amounts may be subject to late payment charges as disclosed on your invoice, not exceeding the maximum permitted by law.
Annual Plans
Annual Plans automatically renew for successive twelve (12) month terms unless either party provides notice prior to the Renewal Date that the Plan will not renew.
Monthly Plans
Monthly Plans automatically renew on a month-to-month basis until cancelled in accordance with Section 4.
- Plan Eligibility and Covered Equipment
Coverage applies solely to residential properties (detached homes, townhomes, modular homes, and manufactured homes permanently affixed to a foundation). Commercial properties are not eligible.
All equipment is subject to inspection and approval and must be in safe working condition at the time of enrollment.
3.1 Diamond Plan
Eligible Equipment:
- Residential furnaces (natural gas and propane)
- Residential air conditioners
- Humidifier parts
- Customer owned hot water tanks
- Customer owned tankless water heaters
Additional Charges:
- No additional labour charges.
- No additional service call charges, including evenings, weekends, and statutory holidays.
- Discounts apply to fireplace maintenance services.
3.2 Platinum Plan
Eligible Equipment:
- Furnaces and air conditioners installed by UHAC.
- Customers previously enrolled in the UHAC Parts & Labour Plan are automatically approved and eligible.
Additional Charges:
- Reduced Weekend Service Charge: $139.95
Applies to weekends (beginning after 5:00 p.m. Friday) and statutory holidays.
3.3 Gold Plan
Eligible Equipment:
- Furnace or air conditioner installed by UHAC.
- Customers previously enrolled in the UHAC Parts & Labour Plan are automatically approved and eligible.
Additional Charges:
- Weekend Emergency Service Charge: $169.95
Applies to weekends (beginning after 5:00 p.m. Friday) and statutory holidays.
3.4 Plan Exclusions (All Plans)
The following components and items are excluded from coverage under the Diamond, Platinum, and Gold Plans unless expressly stated otherwise in writing:
- Heat exchangers (If not covered by manufacturer)
- Venting systems
- Accessories
- Compressors
- ECM motors (After manufacturer warranty expires, a $500 deductible applies)
- Filters
- Humidifier parts
- Thermostats
- Water panels
This Service Plan does not cover any physical damage resulting from misuse, neglect, unauthorized service, physical damage cause by third-party contractors (including but not limited to renovation contractors, landscapers, electricians, plumbers, roofers, duct cleaners or other trades), acts of nature, external damage, or failure to maintain equipment as required under this Agreement.
3.5 Air Conditioner Refrigerant Leaks
Refrigerant leaks are covered only when caused by a single identifiable and repairable failure. Unionville Heating & Air Conditioning will perform one leak repair per covered system during the term of the Plan, provided the leak is not caused by misuse, neglect, physical damage, corrosion, improper installation, or external factors.
Any physical damage to the air conditioning system, refrigerant lines, coils, or related components caused by third-party contractors (including but not limited to renovation contractors, landscapers, electricians, plumbers, roofers, duct cleaners or other trades) is not covered under this Plan.
If additional leaks occur, if the leak cannot be permanently repaired, or if the leak is determined to be caused by coil corrosion, system deterioration, multiple leak points, or external damage, further repairs will not be covered under the Plan. In such cases, the system will be deemed beyond economical repair, and equipment replacement may be recommended at the customer’s expense.
Refrigerant replacement beyond the initial repair, leak searches requiring specialized testing, and repairs involving evaporator coils, condenser coils, or inaccessible refrigerant lines may be excluded at the Company’s discretion.
Refrigerant is covered only in conjunction with an approved leak repair.
- Cancellation
Customers may cancel their Service Plan within 10 days of enrollment without penalty, provided no service, maintenance, repairs, or benefits under the Plan have been provided.
Cancellation by UHAC
UHAC may suspend or terminate this Agreement if you fail to comply with its terms, including payment obligations or required maintenance.
Cancellation by You
Annual Plans
If you cancel prior to the Renewal Date, or if the Plan is cancelled due to non-payment or breach, you remain responsible for unpaid installments for the remainder of the annual term unless otherwise stated.
Monthly Plans
Monthly Plans may be cancelled after one (1) year of active enrollment with a minimum of three (3) months’ written notice. You remain responsible for charges incurred up to the effective cancellation date.
All cancellation requests must be submitted in writing and confirmed by UHAC.
- Refund Policy
There are no refunds once a Service Plan becomes active. Cancellation is subject to Section 4 of this Agreement.
- Modification of Terms
UHAC may modify pricing or Terms and Conditions by providing written notice at least thirty (30) days and no more than ninety (90) days prior to the anniversary date. Changes become effective on the anniversary date.
- Home Sale or Transfer
If the property is sold or ownership changes, the existing Service Plan will terminate for the current customer. The new homeowner may apply to continue the Plan by contacting Unionville Heating & Air Conditioning within 30 days of the change in home ownership to request the transfer. Administrative fees apply.
- Diagnosis and Liability
We will diagnose and repair covered equipment in accordance with this Agreement, provided the equipment is accessible, safe, and located within the permanent foundation of the residence (except central air conditioning units).
We are not liable for indirect or consequential damages, including loss of income, inconvenience, or secondary property damage, to the extent permitted by law.
If a covered repair cannot be completed due to unavailable parts or equipment being beyond repair, we will provide a replacement estimate. We are not responsible for full unit replacement unless expressly stated.
All parts and labour must be supplied and installed by UHAC. Work performed by others voids coverage.
- Payment Terms
The Service Plan may be paid in full at enrollment or through recurring installment billing. By selecting installment billing, you authorize recurring charges at the intervals specified in your confirmation. Applicable taxes apply.
- Rights and Responsibilities
UHAC technicians will provide professional, courteous service and carry proper identification.
You agree to provide a safe, clean, sanitary and unobstructed access to equipment. If a technician feels unsafe or encounters abusive behaviour, UHAC reserves the right to leave and reschedule service.
Acceptance
By purchasing or renewing this Service Plan, you acknowledge that you have read, understood, and agree to all Terms and Conditions outlined in this Agreement.
